If you want to bring your partner and/or a family member to the Netherlands
No distinction is made between family reunification and family formation. Family reunification means that you and your partner, husband or wife were in a relationship before your partner, husband or wife settled in the Netherlands. Family formation means that when the relationship started, your partner was living in the Netherlands.
Such cases are now decided on the basis of the a simplified procedure under the Modern Migration Policy Act (MoMi). What does this mean for you if you want your partner or family member to come and live in the Netherlands?
You will not need to apply separately for a temporary residence permit. In a single procedure, you can request both entry and residence (TEV, or entry and residence procedure).
You must meet a number of conditions to be eligible for a residence permit:
- You must have successfully completed a civic integration examination
- You must have a long-term income
- You relationship must be long-term and exclusive
If you are a highly qualified migrant from outside the European Union and you want to work in the Netherlands
You come to the Netherlands to contribute to the knowledge economy in this country. Your employer must be registered as a designated sponsor. And you will need to apply for a residence permit as a knowledge migrant or highly skilled migrant. Designated sponsors can use the accelerated application procedure.
If your residence permit is withdrawn
If you are arrested in another country, your residence permit may be withdrawn. It can be withdrawn for other reasons as well. Perhaps you and your partner are no longer living together, or you do not meet the income requirements. In an opinion and response procedure, you can explain why you do not agree with the withdrawal.
If you become seriously ill during your stay in the Netherlands
If you become seriously ill while in the Netherlands, this may mean it is impossible for you to go back to your country of origin.
If medical treatment is necessary while you are in the Netherlands, it is extremely risky to travel back to your country of origin. This could result in a medical emergency. So your best option is to apply for a residence permit for medical treatment.
If you are not yet in the Netherlands, and your medical treatment has not yet started, you can still apply for medical treatment in the Netherlands. However, it must be clear that you cannot obtain the care you need in your country of origin, or in another country. This means that the care you need is available only in the Netherlands. In such a case, the IND will ask its Medical Advisors Office (Bureau Medische Advisering, BMA) for advice.
